Let’s just forget about the past for a min and focus on the present.
I can 100% confirm that this most recent Backlink SPAM update that just completed allows for malicious tactics that put your website at risk, especially if it’s a new site.
Oh, and for your scum buckets out there that engage is shady practices like this: I suppose it’s now free game for you and you can now build networks of sites using scraped content to point links at your competition to damage their rankings in Google. I bet if you sprinkle enough porn and/or pharmaceutical content in the mix you are more likely to have your malicious networks of sites flagged as spam.
In addition, if you want to ensure your malicious networks get flagged as spam then interlink them extensively so it looks like you are interlinking them for success. Success in this case being that the site network(s) will be more likely to be flagged as spam networks intended for backlinks if you are making it appear that some of the sites in your malicious network are the “trophy sites”. Trophy here meaning that you are linking all of malicious sites to a small group of sites that will look like you want them to rank well.
Make it obvious to the point that under human review it would appear clearly as a malicious Backlink spam network that is intending to get a a small set of sites in the network to rank. Abuse the footer and sidebars. Make sure most of the sites are on the same IP or C range. Make sure you have multiple sites in the network sharing the same IP.
Some of the sites should have pages that are nothing but links. Try linking to some bad sites as well.
Cherry on top? Add a CTA to all the sites that looks similar that explains to users that they should contact you if you are interesting “buying links”.
Now you are in a spot that will likely trigger a automated filter as well as a human who will deem your whole network spam.
Now: pick some poor souls who’s lives you may ruin and start linking at their websites.
What I am seeing is not an old school Google “banned my site” but a suppression of websites that have shady links. It appears to be a sliding scale.
