Client had quality SEO to their website. Their domain expired and a terminated partner had ownership. Bitterness ensues...and they will not hand over ownership via Godaddy. Are they screwed from an SEO perspective for their new domain (which is the same outside of 1 word)?

As the title says...basically a partner disagreement has taken place in which the original domain for a company expired and the terminated employee/partner had ownership and is unwilling to hand it over. They already had another domain name they were intending to use...and so the site has had to get converted over to it..however anyone going to the old domain is going to get hit with a godaddy parked page.

Is there anything they can do with Google Webmaster tools, etc... to help salvage some of their prior SEO rankings with this new domain? Or is it basically a fresh start at this point, if they are unable to come to an agreement on the old domain?
